By the twisted logic of those spreading this, my husband also isn’t a US citizen. He was born in Hawaii before it achieved statehood. His parents were mainlanders who were in Honolulu during the Pearl Harbor attack and stayed throughout WWII. You only have to have 1 parent who is a US citizen to be a US citizen, or be born on US soil (which doesn’t have to be a state, it can even be an embassy compound).

It’s not as simple as “Case Closed” as this amendment has been tested many times. The Civil Rights Act of 1866 granted US citizenship to all people born in the US. The purpose of section 1 was to provide that former slaves born in the US would be citizens.
Since 1898 the phrase and subject to the jurisdiction thereof has been interpreted to mean that there are some exceptions to the universal rule that birth in United States automatically grants citizenship. The only exceptions to this rule concern diplomats, enemy forces in hostile occupation of the United States, and members of Native American tribes. The distinction between “legal” and “illegal” immigrants was not clear at the time of conception. It was years later in 1924 that Indian Citizens was excluded and rightfully so.

Can you specifically show or direct me to the law that states that anyone born in the USA is a US citizen when both parents are illegal aliens? This is a statement that is continuously being made and quoted but I can not find the actual law that this is indeed fact, and in any subsequent case has the Supreme Court explicitly ruled on whether children born in the United States to illegal immigrant parents are entitled to birthright citizenship via the Amendment.

The 14th amedment is not subject to perceptual idealism. Unless a direct proposal of war is drafted, ratified and set into motion on the floor of congress to the position of “border” infringments by neighboring countries as an outright attack on american soil, the position of illegal children being born in the US cannot hold.

The case isn’t so handily closed. The birth certificate provided by the Obama campaign is an obvious Photoshop forgery and has the certificate number redacted. It could very well be that he was born in Hawaii as he claims, which would then settle the issue. However, it is disturbing that the best he can come up with is a falsified certificate that can’t be verified for lack of a certificate number.

I was in the army for 13 years and my Lil girl was born on an Army base in Europe and she is an American. I think you have made the mistake of stripping away the wrong obfuscations. You claim the “simple fact” that Obama was born on U.S. soil. What is the basis of this assertion? As another poster has already noted, there is significant evidence that birth certificate image that the Obama campaign claims to be genuine, is, in fact, a rather clumsy forgery. Just type Obama birth certificate forgery into your favorite search engine and read all about it. Don’t be fooled by the link to the Stop the Smears website – it contains the image of the birth certificate whose authenticity is in question. If Obama wants to put the controversy to rest he need only produce the original birth certificate for the public’s examination. Or, if he claims to have misplaced it, give written authorization to the Hawaiian authorities to open his birth certificate file to the public. His failure to take such a “simple” step is proof of obfuscation.

Does Obama have a US passport? If so, he had to prove to the State Department that he was a citizen at the time he applied for the passport.
But, depending on the circumstances of their birth, some people do not have a birth certificate. My mother was born at home and so did not have a birth certificate. When she applied for a passport, she had to find some people who knew the circumstances of her birth to write a statement for her to include with her passport form. Luckily, her older brothers and sisters were at home when she was born, and were able to provide these statements.
Besides, if this story was true, I am sure that Hillary Clinton would have been all over it from the get-go. That both she and Bill Clinton and others have ignored it demonstrates to me that this story doesn’t have legs.

O – I am a US citizen. My husband is a Swiss citizens. Both of my sons were born on Swiss soil and yet they are both US citizens at birth. We have certifications from the Embassy so declaring. They have Soc. Sec. numbers and US passports. Even if Obama were born in a foreign country to ONE US citizen parent (and my understanding is he was born in Hawaii anyway) he could still be a US citizen AT BIRTH as my two sons are.

The description of his ethnic roots is shown as “Black”, yet in 1961 that term was never used, the word “Negro” was the term used. Obama and the DNC has failed to answer certified legal documents, and failed to provide a certified birth certificate.
This is interesting since not an hour ago, I looked at Urban Legands as to whether or not O’Bama is a native born citizen of the U.S.A. It came back there was no info available on this. So, you might question this person’s reply stating he’s connected with Urban Legands site. I’m not buying it!

Here’s the real truth. Bush senior has already said Arnold could someday be president.
So Barak gets elected. Kenya unseals his birth record which is now allegedly sealed. Democratic congress amends the constitution allowing Barak to stay, calling this the “will of the people”.
He turns out to be just a dull do nothing president just like his senate term.
Then in 2012 Arnold the governator runs for president under Baraks new rules and wins by huge landslides in a fun campaign with all kinds of catcy phrases and tag lines.

You can also see a birth announcement from the Honolulu Advertiser from 1961. The format of documents like Birth Certificates and Marriage Licenses varies from state to state, and even county to county. The state Registrar could very well have signed the back of the document, whether it was the original in 1961, or a duplicate in 2007 or 2008. Depending on how the document is folded the signatures are not necessarily on the front. They are often “signed” on the “back”, which is the side that shows when it is folded. I’m a pastor, with children having been born in two different states, and three different counties. None of the original birth certificates is the same, with signatures in different location. Face it folks, he was born in the United States of America, when he was born he held dual citizenship in the United States of America & Kenya, but his Kenyan citizenship lapsed when he turned 21, when he did not reject his United States of America citizenship and did not affirm his Kenyan citizenship.
Some of you people really need to get a clue. If Obama was full all of these lies and deceit he would have been dropped in the Primary. This man graduated from Columbia, Harvard and passed the Illinois State Bar. If there was any single thing that was fraudulent about him he would not have made it through any of that especially with the Illinois State Bar. He also taught Law for many years, don’t u think they do background checks to teach at a University ? He doesn’t have to show his birth certificate to a crazed attorney with a history of filing Government lawsuits including one charging Bush with being inside responsible for the 9/11 attacks. SUMMARY: Since we published Obama’s birth certificate, questions about its authenticity have been frequent and fierce. After reviewing the evidence, we’re confident in our rulings.
It started as a whisper, a trickle of nagging doubt.
“As a concerned citizen, I’m wondering if there isn’t something fishy going on with the Obama certificate.”
“I have serious doubts about the purported ‘birth certificate’ you were sent.”
“Something doesn’t smell right.”
Soon, e-mails and blog posts were flying. As the pace quickened, the tone sharpened.
“You should be apologizing … for your misinformation regarding BO bogus birth certificate, that you claimed was genuine!”
At full throttle, the accusations are explosive and unrelenting, the writers emboldened by the anonymity and reach of the Internet.
And you can’t help but ask: How do you prove something to people who come to the facts believing, out of fear or hatred or maybe just partisanship, that they’re being tricked?

Sen. Barack Obama’s birth certificate is a document PolitiFact.com had sought for months. Countless chain e-mails, seeking to paint him as a secret Muslim, speculated that his full name included Muhammed (or Mohammed). Some said he is not an American citizen.
Birth Certificate
As a fact-checking news Web site, we went to extensive lengths to sort out the truth. We got a copy of his 1992 marriage certificate from the Cook County (Ill.) Bureau of Vital Statistics. His driver’s license record from the Illinois Secretary of State’s office. His registration and disciplinary record with the Attorney Registration & Disciplinary Commission of the Supreme Court of Illinois. Not to mention all of his property records.
Not one of these documents shows a Muhammed (or Mohammed) in Obama’s name. They all read “Barack H. Obama” or “Barack Hussein Obama.”
The ultimate document we sought was Obama’s birth certificate. Unlike the other documents, Hawaii birth certificates aren’t public record. Only family members can request copies, so when the campaign declined to give us one, we were stalled.
On June 13, 2008, Obama’s campaign finally released a copy, while launching a fact-check Web site of its own, Fightthesmears.com. The site is a direct response to allegations about Obama that won’t go away: He’s Muslim. He took the oath of office on a Koran. He refuses to say the Pledge of Allegiance. PolitiFact has researched all of these accusations and none of them are true.
When the birth certificate arrived from the Obama campaign it confirmed his name as the other documents already showed it. Still, we took an extra step: We e-mailed it to the Hawaii Department of Health, which maintains such records, to ask if it was real.
“It’s a valid Hawaii state birth certificate,” spokesman Janice Okubo told us.
Then the firestorm started.
• Where is the embossed seal and the registrar’s signature?
• Comparing it to other Hawaii birth certificates, the color shade is different.
• Isn’t the date stamp bleeding through the back of the document “June 2007?” (Odd since it was supposedly released in June 2008.)
• There’s no crease from being folded and mailed.
• It’s clearly Photoshopped and a wholesale fraud.

At PolitiFact.com, we’re all about original sources. We don’t take anyone at their word or take the reporting of other media organizations as proof. We go to the heart of the story, the source of the truth — original, corroborating documents.
When the official documents were questioned, we went looking for more answers. We circled back to the Department of Health, had a newsroom colleague bring in her own Hawaii birth certificate to see if it looks the same (it’s identical). But every answer triggered more questions.
And soon enough, after going to every length possible to confirm the birth certificate’s authenticity, you start asking, what is reasonable here?
Because if this document is forged, then they all are.
If this document is forged, a U.S. senator and his presidential campaign have perpetrated a vast, long-term fraud. They have done it with conspiring officials at the Hawaii Department of Health, the Cook County (Ill.) Bureau of Vital Statistics, the Illinois Secretary of State’s office, the Attorney Registration & Disciplinary Commission of the Supreme Court of Illinois and many other government agencies.

Peter Goelz knows a little something about conspiracy theorists.
He was managing director of the National Transportation Safety Board in 1996 when TWA Flight 800 crashed off Long Island, killing 230 people. While the NTSB’s investigation found no evidence of sabotage or terrorism, the Internet was stocked with insistent accusations.
“We were right at the beginning of this Internet lunacy,” Goelz said in an interview with PolitiFact. “And there were a variety of crackpot Web sites and Web commentators that generated all sorts of rumors. The principle one was that TWA in fact was shot down by an errant Navy missile in … a live-fire exercise off the Hamptons.”
Nine miles off Long Island, in the middle of summer. And then a full-scale coverup by the Navy and all the sailors involved.
“I am sure that we spent another $10-million, perhaps $20-million, out of a $50-million investigation, to just knock down and put to bed these kinds of rumors, these insidious rumors,” Goelz said. “We felt like we had to answer every question because it was such a public and dreadful and confounding event.”
Goelz, who is now a communications consultant in Washington, D.C., says the Internet has given a platform to anyone to say anything. And a way to find others who want to hear it.
“Online, they can be almost anything,” he said. “They can be the crusading investigators that they always wanted to be.”

The Hawaii Department of Health receives about a dozen e-mail inquiries a day about Obama’s birth certificate, spokesman Okubo said.
“I guess the big issue that’s being raised is the lack of an embossed seal and a signature,” Okubo said, pointing out that in Hawaii, both those things are on the back of the document. “Because they scanned the front … you wouldn’t see those things.”
Okubo says she got a copy of her own birth certificate last year and it is identical to the Obama one we received.
And about the copy we e-mailed her for verification? “When we looked at that image you guys sent us, our registrar, he thought he could see pieces of the embossed image through it.”
Still, she acknowledges: “I don’t know that it’s possible for us to even say beyond a doubt what the image on the site represents.”

And there’s the rub. It is possible that Obama conspired his way to the precipice of the world’s biggest job, involving a vast network of people and government agencies over decades of lies. Anything’s possible.
But step back and look at the overwhelming evidence to the contrary and your sense of what’s reasonable has to take over.
There is not one shred of evidence to disprove PolitiFact’s conclusion that the candidate’s name is Barack Hussein Obama, or to support allegations that the birth certificate he released isn’t authentic.
And that’s true no matter how many people cling to some hint of doubt and use the Internet to fuel their innate sense of distrust.

Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States filed a Writ of Certiorari in the United States Supreme Court on October 30, 2008, requesting review of the United States District Court, Eastern District of Pennsylvania, Judge Surrick’s Dismissal of Philip J. Berg’s lawsuit against Barack H. Obama, Jr., the DNC and the other co-Defendants. Accordingly, the U. S. Supreme Court has set dates in which Barack Obama, the DNC and all co-Defendants are to respond to the Writ, which is on or before December 1, 2008.
Mr. Berg remarked today, “I look forward to receiving Defendant Obama’s response to the Writ and am hopeful the U. S. Supreme Court will review Berg v. Obama. I believe Mr. Obama is not a constitutionally-qualified natural-born citizen and is ineligible to assume the office of President of the United States.”
Mr. Berg’s case, Berg vs. Obama was dismissed from the United States District Court for the Eastern District of Pennsylvania, Docket # 08-cv-4083 for lack of standing. Mr. Berg filed a Writ of Certiorari for review of the case and an injunction to stay the election pending review. Justice Souter denied the injunction. It is expected that the Court will decide whether or not to review Berg v. Obama after the Defendants file their response, and Mr. Berg has replied to the Defendant’s response.
The Defendants’ response is due by December 1st and Mr. Berg’s reply will be submitted thereafter.

Good luck with that lawsuit. The Supreme Court won’t grand a review. Mr. Berg is an unethical lawyer (http://www.law.com/jsp/article.jsp?id=1122023117263) looking for publicity by pursuing an unwinnable case.
I had begun to dispute some of the factual inaccuracies in previous posts, but opinions like these haven’t been developed by reason, and aren’t malleable. The tails of the distribution are occupied by people who are susceptible to manipulation by others with hidden agendas and conspiracy theorists who blame space aliens, commies, terrorists or whatever is handy when circumstances don’t suit their agendas.

Supreme Court Of The United States (SCOTUS) Justice David Souter has agreed that
a review of the federal lawsuit filed by attorney Phil Berg against Barack
Hussein Obama II, et al., which was subsequently dismissed for lack of standing
is warranted. SCOTUS Docket No. 08-570 contains the details.
A review of that docket and the Rule 10 of the Supreme Court makes abundantly
clear that Justice Souter’s granting of a review on the Writ of Certiorari is
not a right entitled to citizen Phil Berg, but rather is a matter of judcial
discretion based upon a compelling reason. That compelling reason is the
Constitutional requirement that “No person except a natural born citizen …
shall be eligible to the office of President…”
What this means is that on or before 1 DECEMBER 2008 Barack Hussein Obama II
must respond to the writ of certiorari, and since the Berg v Obama case hinged
primarily on the question of Obama’s place of birth, it is almost inconceivable
that Barack Obama will thumb his nose at the Justices of the Supreme Court and
he is absolutely compelled to provide a vault copy his original birth
certificate.
Even if Obama produced authenticated proof of his birth in Hawaii, however, the
suit claims that the U.S. Nationality Act of 1940 provided that minors lose
their American citizenship when their parents expatriate. Since Obama’s mother
married an Indonesian citizen and moved to Indonesia, the suit claims, she
forfeited both her and Barack’s American citizenship
If Obama was a US born citizen he would have turned over his original birth certificate immediately. He would not have 8 lawsuits pending against him. I believe he was born in Kenya. His paternal grandmother has said so on tape. Supposedly he stated in an dabate with Alan Keyes that he was not a natural born citizen.

According to his Maternal Grandmother Sarah Obama, who says she witness his birth in “Mombasa, Kenya” on August 4th 1961. If this is true then Barack Obama is not a U.S. Citizen, but a British Citizen for Kenya was a British colony at that time. That would make him ineligible for President of the United States under Article II Section 1. She is willing to testify against her own grandson with her interpreter, if need be through Bishop Ron McRae via Phillip J. Berg.
Facts: (1) Obama was likely born in Kenya, but out-of-wedlock. (2) Under Hawaiian family law statute(s) and Hawaiian case law, the purported Hawaiian marriage of Obama’s pregnant mother was “void ab initio” and not merely voidable due to the fact Obama’s father at the time was already married. (3) Accordingly, an entirely different set of citizenship laws apply because of the out-of-wedlock birth. (4) Since Obama’s United States’ citizen mother had been physically present in the United States for a continuous period of one year prior to Obama’s birth, Obama is deemed a “natural born” United States’ citizen at birth. (6) The country of his birth and his “original birth certificate” are effectively moot issues. Should the first marriage be proven President-elect Obama becomes President Obama come January. Ranger, you’ve misunderstood the process, or you’re listening to people who don’t understand it. Cert has not been granted; Obama does not need to respond. There is a “Petition for a writ of certiorari before judgment filed. (Response due December 1, 2008)” on the docket (here’s the docket: http://origin.www.supremecourtus.gov/docket/08-570.htm )
The entity responding here is the Supreme Court, which will respond to Mr. Berg’s petition either by granting cert or rejecting it. No response is required by Mr. Obama, because the Court has not yet agreed to hear the case.
Latest Barack Obama case as to his qualifications as a “natural born citizen” per the U.S. Constitution is at the U.S. Supreme Court (SCOTUS). It is Donofrio vs. Wells of NJ. Obama’s grandmother (Sarah Obama) says she was present when “he” was born, but in context the last male person discussed prior to the use of the word “he” was “her son” not “her grandson”. (Sarah is the stepmother of the president elect’s father.) I don’t know where that stuff about Mombasa and hospital delivery rooms comes from…probably just a tale that grows in the telling. First, I agree that Ranger has absolutely no idea what he is talking about. A request for a Writ of Certiorari is nothing more than a request that the Supreme Court use its discretion and choose to hear a case that it is not required to hear (it has that right under the Constitution). An Appellee may choose to respond, or not, as he or she chooses. He may choose not to respond because he feels that the suit will fail of its own defects, and is not worth the time and expense of his response.
However, Ranger sounds like a college professor next to Gerard (56). He regurgitates long-discredited tax-protestor semantical garbage about a purported difference between being a UNITED STATES citizen and a citizen of the United States of America, and about how the UNITED STATES consists only of Washington, DC and federal enclaves. That brand of idiocy has NEVER prevailed in ANY US court, and often brings sanctions for frivolous pleadings against the fools who submit them.
But, that’s not all. He then claims that the word “Black” on Obama’s purported birth certificate proves that it’s a forgery; otherwise it would have listed him as “Negro”. Well, I’ve looked at US censuses from 1830 through 1920 while researching my ancestry. I’ve looked at every listing I could find where the surname matches my own; and I’ve excluded many listings from possible places on my (Caucasian) family tree because the card bears a “B” or the word “Black”.
And then, he caps things off by citing Rule 36 of the Federal Rules of Civil Procedure to assert that nonresponse to certain claims after 30 days serves as an admission of the truth of those claims. If Gerard is such an expert on the FRCP, he ought to look at Rule 12b6. That rule allows a suit to be dismissed for failure to state a claim upon which relief can be granted. In other words, Obama can simply look at the lawsuits and say “these are going to be dismissed before they even reach trial, or even the discovery phase of the pre-trial process. They’re not worth a minute of my time or a dollar of my money.”
Someone once said “a little knowledge is a dangerous thing”. Okay, well Hawaii became a state on August 21, 1959. Obama was born on August 4, 1961. I guess people are so stupid that they are just saying what other people say. But I read some people say above he was born before Hawaii was a state. WRONG!!! I think you could take a IQ test or a citizen test before you are allowed to vote! Couple of things:
I don’t care if he is white, black, brown, or purple with pink polka dots — one of the job requirements to be president is to be a natural born citizen of the United States. Just like every other person who has to provide proof and documentation of meeting the requirements of a job position (ie. if you job requires you have a college degree, you have to submit an official transcript or if you must have a good driving record, you have to submit a copy of it to your employer PRIOR to being hired!) It’s not a racial issue — this proof should be required before you are allowed to even officially join the race. Besides, this is PUBLIC RECORD when you step into politics!
Sooooooo……….that being said, why then did the DNC and the Obama campaign and now the administration spend an outrageous amount of money to fight each and every open records request seeking this information???? If there is nothing to hide, why spend money you don’t have to spend?
There is an easy solution. It’s a consitutional requirement to be president. If he is a natural born citizen, the simple way to end all the questions and speculation is to ALLOW THE OPEN RECORDS REQUESTS TO BE FILLED BY THE AGENCY WHICH HOLDS THE DOCUMENT.
The agency certifies it’s authenticity, it isn’t handled through Obama staff to remove information which would prove the documents veracity, and thus it’s credibility is much less marred.
The longer he plays this secret game, the more it lends people to believe he has something to hide.
From this point forward, it should be a requirement that documents should be submitted to the Secret Service and jointly with the FBI they should be required to investigate the veracity of all documentation proving natural born citizenship. This should happen prior to anyone being able to announce they are joining a race seeking to be elected president.
The person who is elected, prior to taking office, should have their information reviewed by the Supreme Court along with the investigation done by Secret Service/FBI or CIA or whomever. Once it is deemed valid in the Supreme Court, then, and ONLY then can that person take the oath of office and be sworn in as the President.
So, the LOGICAL thing is to simply allow the open records act to work as it was designed and alleviate questions concerning your eligibility to hold the office!
So, Mr. President — if you have nothing to hide regarding your citizenship status, then do what you KNOW is the right thing and exonerate yourself in the process. I have had to prove my eligibility to work at every job I’ve ever done. Why can’t you????

Factcheck is , a web site, not a government organazation, they are simply an on-line provider. Let me clear up a few facts for you. Mr. Obamas own grandmother who resides in Kenia came foward with her own statement that in Fact Mr. Obama was born in Kenya and shortly after at 4 months of age traveled back to the United States. State Attorney Philip Berg has filed a lawsuite against Mr. Obama who I might add is a democrat. The DNC Mr. Obamas group og hired lawyers are trying to dismiss the lawsuite, make it go away. The fact as you state it is that if you go on line and look at the copy of Mr. Obamas birth certificate has a color coed stamp from the state of Hawaii, when in fact that color was not used in that year. Now you may ask how I personally know this, the truth is that my mother worked for the state of Hawaii government statehood department, which means she was part of the goverment agency that helped Hawii through its statehood with the US.

New Hawaii law shuns Obama birth document requests
HONOLULU (AP) — It’s now law in Hawaii that the state government can ignore repetitive requests for President Barack Obama’s birth certificate.
Republican Gov. Linda Lingle signed into law Wednesday a bill allowing state government agencies not to respond to follow-up requests for information if they determine that the subsequent request is duplicative or substantially similar to a previous request.
The law is aimed at so-called “birthers,” who claim Obama is ineligible to be president. They contend the Democratic president was born outside the United States, and therefore doesn’t meet a constitutional requirement for being president.
Lingle didn’t elaborate on her reasons for signing the bill, but state Health Director Dr. Chiyome Fukino previously issued statements saying that she’s seen vital records that prove Obama was born in Hawaii and is a natural-born American citizen.
Both Fukino and the state registrar of vital statistics have verified that the Health Department holds Obama’s original birth certificate.
Health Department officials supported the law because the state still gets between 10 and 20 e-mails seeking verification of Obama’s birth each week, most of them from outside Hawaii.
A few of those requesters file repeated inquiries seeking the same information, even after they’re told state law bars release of a certified birth certificate to anyone who does not have a tangible interest.
Advocates for openness in government oppose the law because they fear it could be used to ignore legitimate requests for information.

The US Supreme court ruled to clarify the natural citizen in Dec. 2011. Which means obama does not qualify so why is he running again? He abides by no laws of this land. His loyality is not with this country. He gave up his citizanship, if he ever had it, to become a citizen to attend muslium school. That country does not allow duel citizenship.
